摘　　要：2021年新《中华人民共和国行政处罚法》对中国行刑衔接工作机制进一步地完善。目前在中国渔业案件领域,行政执法与刑事司法的衔接上仍面临许多困境,包括法律条衔接不力、证据移送不流畅、缺乏有效监督机制等。鉴于渔业案件其自身的特殊性,有必要针对所面临的困境进一步完善渔业行政执法与刑事司法的衔接路径。In 2021,the new Administrative Punishment Law of the People’s Republic of China has further improved the working mechanism of Chinese execution linkage.At present,in the field of fishery cases in China,there are still many difficulties in the connection between administrative law enforcement and criminal justice,including the weak connection of legal articles,the lack of smooth transfer of evidence,and the lack of effective supervision mechanism.In view of the particularity of fishery cases,it is necessary to further improve the connection path between fishery administrative law enforcement and criminal justice.
