摘　　要：技术法规概念是技术法规理论体系构建的基础。我国技术法规研究兴于加入WTO,源于对《技术性贸易壁垒协定》(简称《TBT协定》)项下技术法规概念及制度安排的接受,但也局限于《TBT协定》。这情况已不能满足技术法规作为一种普遍法律现象的实践需要。虽然技术法规呈现不同形态,但都涉及两个基本面:一是技术法规属于法律规范范畴,有别于标准;二是技术法规与标准化存在密切联系。技术法规概念应界定为:技术法规是规定技术要求的一种特殊的法规范,具有技术性、义务性、双重规范等特征。技术法规是法律引用标准的产物,是对标准化成果的利用。The concept of technical regulations is the foundation for the establishment of a theoretical system of technical regulations. The research of Chinese technical regulations arose from the acceptance of the concept of technical regulations and institutional arrangement under the TBT Agreement,which,however,was confined to the TBT Agreement. It can no longer meet the practical needs of technical regulations as a universal legal phenomenon. By examining technical regulations under the TBT Agreement,extraterritorial laws,field of standardization as well as Chinese laws and legal theories,we found that although technical regulations take on different forms,they all involve two fundamentals: first,technical regulations belong to the category of legal norms,which are different from standards;second,there is a close relationship between technical regulations and standardization. The concept of technical regulations should be defined as: a special legal norm to specify technical requirements featuring technology,obligation and double norms.Technical regulations are the outcome of legal reference standards and the use of achievements of standardization.
