摘 要:“一带一路”倡议是实现人类命运共同体理念的路径之一,在“一带一路”背景下基础设施的建设充满机遇与挑战。国际软法基于自身特有的优势及在国际社会中产生的良好实践效果,为解决基础设施建设中的制度困境提供新的选择。通过对国际社会及基础设施建设中的软法实践分析,提出基础设施建设中的软法在坚持互利共赢原则的前提下,结合基础设施建设领域的特殊性,还需制订包含更多关于技术标准统一协调的软法策略及发挥企业在软法制订中的积极性,并提出借鉴“管理过程模式”与“开放协调机制”,从信息分享、利益激励、声誉激励三个层面的制度设计来保障对软法的遵守,进而推动“一带一路”基础设施建设顺利进行。The“Belt and Road”Initiative is one of the ways to realize the community of common destiny for all mankind,Under the background of the“Belt and Road”Initiative,infrastructural construction is full of opportunities and challenges.International soft laws are an alternative out of the systematic dilemma in infrastructural construction due to their own merits and the good results achieved in international practice.Through the analysis of the practice of soft laws in the international community and infrastructure construction,it is proposed that the soft laws in infrastructure construction should,while in line with the win-win principle of mutual benefit,be combined with the particularity of the field of infrastructure construction,that it is necessary to formulate soft laws that include more harmonization and coordination of technical standards,and give full play to the enthusiasm of enterprises in the formulation of soft laws,and that drawing from“management process model”and“Open Method of Coordination”,specific soft law systems be designed from three aspects of information sharing,benefit incentives and reputation incentives to ensure compliance with soft laws and the smooth progress of the“Belt and Road”infrastructural construction.
