身体哲学视域下身体形式完整权研究  

On the Right to Bodily Integrity in the View of Body Philosophy

摘　　要：《民法典》第1003条规定身体完整系身体权的内容,而身体免受触碰这一形式完整权是否是身体权的内容,学界对此莫衷一是。现代哲学从意识哲学转向身体哲学,身体即主体,不仅是被感知的客观对象,更是感知主体。在身体哲学的具身理论指导下,以身体完整为内容的身体权实现了从边界完整到具身完整的理论嬗变。《民法典》第1010条和第1011条规定了两种侵犯身体权的行为:性骚扰侵权和非法搜查身体侵权,这以反面禁止的方式将身体免受触碰这一形式完整权纳入身体权的内容之中,平息了学界争论,回应了身体哲学转向和现实问题,凸显了立法技术的进步性和人民性。但身体形式完整权的内容丰富,仅以对上述两种行为的侵权救济无法实现对身体形式完整权的全面界定和保护。《民法典》人格权编的司法解释应以主观权利的方式正面界定身体权中的形式完整权。Article 1003 of the Civil Code stipulates that the right to bodily integrity is the content of the body right,but there is no agreement on whether the formal integrity right of body free from touch is the content of body right.Modern philosophy has shifted from the philosophy of consciousness to the philosophy of the body.It means that the body is more the subject than the object to be perceived.Under the guidance of embodied theory of body philosophy,the right to bodily integrity has realized the theoretical transmutation from boundary integrity to embodied integrity.Articles 1010 and 1011 of the Civil Code regulate two types of violations of the right to the body:The tort of sexual harassment and the tort of illegal search of the body,which incorporate the right to be free from touch into the content of the right of body in a negatively prohibited manner.It has settled the academic debate,responded to the physical turning of the subject philosophy and practical problems,and highlighted the progress and people's nature of legislative technology.Although its content is rich,the right to bodily integrity can not be fully defined and protected only by the tort remedy for the above two acts.The judicial interpretation of"Civil Code·Personality Right"should positively define the right to formal integrity in the context of bodily rights in terms of subjective rights.
