摘 要:面部识别技术在为人类社会生活带来一定便利的同时,也隐含着权利风险与殷忧。将该技术引入权利分析框架中可发现,作为特殊的生物识别信息,面部信息承载着人权、人格权及个人信息(权)等三重维度、不同位阶、逐层嵌套的基本权利及具体权利,需要明确面部信息的权利属性,有效区分该技术带来的不同层次的权利风险,并从国家、社会和个人等不同主体角度对该技术层次各异的需求出发,适度且综合运用比例、诚信和自愿等三大原则,有效规制该技术在个人权利方面带来的安全风险,保障合理应用,并促进良性发展。Face recognition technology(FRT) brings certain convenience to social life, but also implies the risks and worries about rights. As a special biometric information, face information contains the basic rights such as human rights, personality rights and personal information rights, and specific rights to form a hierarchical relationship. It is necessary to clarify the right attributes of face information, distinguish the different levels of rights and risks brought about by face recognition technology, and proceed from the needs of different levels of the technology by the state, society and individuals. We should appropriately apply the principle of proportionality, the principle of good faith and voluntary principle to effectively regulate the security risks involved by face recognition technology in terms of personal rights, ensuring the reasonable application and healthy development of face recognition technology.
