水电工程工期延长导致的临建费用补偿探讨

摘　　要：水电工程的项目及工程量巨大,工期长,受各方面的影响,工期延长属于较常见的现象。文章首先对工期进行分析,判断工期延长的原因,确定工期延长的责任归属;再从法律、法规角度分析工期延长导致的临建费用补偿的法律依据,从招标投标文件等角度分析工期延长导致的临建费用补偿的合同依据,进而分析工期延长导致的临建费用补偿的原理(即补偿成立的基础);探讨了工期延长导致的临建费用补偿涵盖范围,包括临建房屋(生产及生活用房)的摊销及维护费用,施工供风、供水、供电的设施摊销费用以及维护费用等费用;分析了以上几种类型的临时设施补偿处理原则以及费用计算方法。文章提出的水电工程工期延长导致的临建费用补偿方法具有较强的指导性,在水电行业具有较强的借鉴性。The projects and quantities of hydropower projects are huge and the construction period is long. Affected by all aspects, the extension of construction period is a common phenomenon.Firstly, this paper analyzes the construction period,judges the reasons for the extension of the construction period, and determines the responsibility of the extension of the construction period;then analyze the legal basis of temporary construction cost compensation caused by the extension of construction period from the perspective of laws and regulations, and analyze the contract basis of temporary construction cost compensation caused by the extension of construction period from the perspective of bidding documents. Then it analyzes the principle of temporary construction cost compensation caused by the extension of construction period, that is,the basis of compensation. This paper discusses the coverage of temporary construction cost compensation caused by the extension of construction period, including the amortization and maintenance cost of temporary buildings, including production and living houses, the amortization cost and maintenance cost of construction air supply, water supply and power supply facilities, and analyzes the compensation treatment principles and cost calculation methods of the above types of temporary facilities,and analyzes the treatment principles and cost calculation methods of the above types of temporary facilities compensation.The compensation method for temporary construction costs caused by the extension of the construction period of hydropower projects proposed in this paper has a strong guidance and a strong reference in the entire hydropower industry.
