论海南自贸港建设利用外资及风险防范机制问题

摘　　要：在世界贸易投资规则和格局重构之时,建设中国(海南)自由贸易试验区并适时推进中国特色自贸港建设具有重大影响,引发了世界各国对中国特色自贸港建设的高度关注,吸引了大量的外资不断涌入海南参与自贸港建设。这些外资涉及自贸港建设的各个方面,覆盖面广泛且蕴含着巨大的信息,外资发挥着资源配置的特定功能和价值。以中国特色自贸港发展中的利用外资风险防范为研究对象,运用利益平衡原则和法治理念平衡外资利用与风险防范、改革开放与管制创新间的关系,以此认清外资可能引发产业安全、环境生态、技术垄断以及金融层面的诸多风险,提出以下可行性的路径选择:着眼于海南自贸港创新机制,坚定开放和安全平衡的基本立场;着眼于海南自贸港具体实践,做好利用外资风险防范;着眼于海南自贸港新机遇,丰富利用外资新理论实践。When the rules and patterns of world trade and investment are reconstructed,the construction of China(Hainan)Pilot Free Trade Zone and the timely promotion of the construction of free trade ports with Chinese characteristics have great influence,which has aroused the high attention of countries around the world,and attracted a large number of foreign capital to continuously pour into Hainan to participate in the free trade ports construction.These foreign investments involve in all aspects of the construction,contain huge information,and play a specific function and value of resource allocation.Taking the risk prevention of foreign capital in the development of free trade ports with Chinese characteristics as the research object,the relationship between utilization of foreign capital and risk prevention,reform and opening up as well as regulatory innovation can be applied by the principle of interests balance and the concept of rule of law to clarify the risks that foreign capital may cause in industrial safety,environmental ecology,technology monopoly and finance.Feasible path choices thus are proposed as follows:focusing on the innovation mechanism and firmly maintaining a balance between openness and security;focusing on the specific practice and preventing the risk of foreign capital utilization;focusing on the new opportunities and enriching the new theory and practice of utilizing foreign capital.
