摘　　要：近年来,我国营商环境显著改善,世界银行对我国营商环境的评价迅速提升。然而,由于计划经济传统及经济体制等因素的影响,我国营商环境也有自身特殊的问题——行政性垄断影响市场公平竞争环境。公平竞争的市场环境是营商环境的重要方面,而在现实生活中,因行政权力的不当行使而妨碍、限制市场主体公平竞争的现象客观存在。为此,必须强化我国营商环境中维护公平竞争的体制、机制建设,正确处理竞争政策与产业政策的关系,进一步拓展公平竞争审查制度的适用空间,增强对弱势市场主体的特别保护,健全针对行政性垄断行为的有效救济和约束机制。唯有如此,才能实现我国营商环境的实质性改善和全面优化。In recent years,China’s business environment has improved significantly,and the World Bank.s evaluation of China’s business environment has rapidly improved.However,due to the influence of the planned economy tradition,economic system and other national factors,China’s business environment also has its own special problem,namely,the problem of administrative monopoly affecting the fair competitive environment of the market.The market environment of fair competition is an important aspect of the business environment,but in real life,there are many phenomena that impede and restrict the fair competition of market entities due to the improper exercise of administrative power.To this end,it is necessary to strengthen the construction of systems and mechanisms for maintaining fair competition in China’s business environment,correctly handle the relationship between competition policy and industrial policy,further expand the space for the application of the fair competition review system,enhance the special protection of weak market entities,and improve the effective relief and restraint mechanism for administrative monopoly acts.Only in this way can we achieve substantial improvement and comprehensive optimization of China’s business environment.
