摘　　要：GENCON 2022于2022年5月18日通过,对船东和租船人的权利义务进行了全面详尽的分配。在使用GENCON 2022时,租约双方应更注重删减、替换条款而不是增加条款,从而减少合同解释和适用的困难;与CONGENBILL 2022有关的条款将使租船人承担较大的法律风险;法律与仲裁标准条款的优先适用规则值得关注,在选择适用中国法时,部分条款可能因违反国内强制性法律规范而无效。GENCON 2022,which was adopted on May 18,2022,provides a comprehensive and detailed allocation of the rights and the obligations of shipowners and charterers.When using GENCON 2022,both parties should pay more attention to deletion and replacement of clauses rather than adding clauses,which shall reduce difficulties in contract interpretation and application;the clauses related to CONGENBILL 2022 will expose charterers to greater legal risks;the rules of priority application of legal and arbitration standard clauses are worthy of consideration,and in the choice to apply Chinese law,some clauses and terms may be invalid due to violation of domestic mandatory legal norms.
