摘  要:新经济业态催生了新就业形态。支持和规范发展新就业形态是新时代我国劳动力市场面临的具有前沿性、复杂性的重大课题。平台经济的兴起及劳动者工作理念的转变等因素促成了新型灵活就业群体的产生,这也导致传统用工关系中劳动关系或劳务关系“二元论”划分模式不合时宜。劳动关系归属模糊、劳动风险加大、缺乏社会保障支持等问题,让该类群体劳动权益面临“保护网络的缝隙跌落”困境。大部分灵活就业群体实际上处于企业和社会“双重体制保障”之外的状态,现实中既被“经济性接纳”,又被“社会性排斥”,主要表现为他们实际上是平台企业的“核心”资源,却被企业挡在“外环”。同时,他们也是享受城市公共产品资源的体制外群体,与标准劳动关系形式上的差异性和劳动权益保障力度的不均衡性等引发数量较多、案情复杂化的劳动争议,从而影响了和谐劳动关系的构建,也不利于“稳就业”“保民生”等重要目标的稳步推进。为切实维护新就业形态下灵活就业群体劳动权益,应重新厘定劳动关系认定标准,对不同类型的灵活就业群体采取分类别差异化保护措施,完善多层次社会保障制度,加强综合应对举措。The new economic forms have given birth to new forms of employment.Supporting and standardizing the development of new forms of employment is a major cutting-edge and complex issue faced by China’s labor market in the new era.The rise of platform economy and the change of workers’work concept have contributed to the emergence of new flexible employment groups,which also lead to the traditional labor relations or the“dualism”division model of labor relations no longer appropriate.Problems such as vague ownership of labor relations,increased labor risks,and lack of social security support make the labor rights and interests of such groups face the dilemma of“gap drop in the protection network”.In fact,most of the flexible employment groups are outside the“dual system guarantee”of enterprises and society,while they are in a state of conflict between“economic acceptance”and“social exclusion”be⁃cause they are actually the core resources of platform enterprises,but are blocked by enterprises in the“outer ring”.At the same time,they are also outside the system groups that enjoy urban public resources.The differences in the form of standard labor relations and the inequality of labor rights and interests protection have caused a large number of labor disputes with complicated cases,which have af⁃fected the construction of harmonious labor relations and is not conducive to the steady progress of important goals such as“stable em⁃ployment”and“ensuring the people’s livelihood”.In order to effectively safeguard the labor rights and interests of flexible employment groups under the new employment pattern,we should redefine the criteria for identifying labor relations,take differentiated protection measures for different types of flexible employment groups,improve the multi-level social security system,and strengthen comprehen⁃sive response measures.
