南繁活动中育种材料的权属关系及产权保护

摘　　要：南繁是指在北方地区从事种业或育种的人员在冬季到南方(海南岛)开展农作物繁育的活动,主要包括育种资源的鉴定、育种材料的配置、中间材料加代、扩大、育成品种的繁殖以及杂交种子的组配。育成材料是拥有人的一种实物资产和无形资产,拥有所有权和知识产权。在南繁活动中,育种材料的交流、流失以及逃逸时常发生,导致实质上侵权行为的产生。本研究从南繁活动的各种形式中,分析了育种材料的权属关系,以及在实践中可能产生的侵权行为,以期为南繁单位和南繁人员对所有权和知识产权的保护提供参考。Nanfan(Southern breeding) refers to the activities of crop breeding carried out in the south(Hainan Island) in winter by people engaged in seed industry or breeding in the northern region in China, mainly including identification of breeding resources, allocation of breeding materials, addition of intermediate materials, reproducing seeds, breeding of bred varieties and combination of hybrid seeds. Breeding materials are a kind of physical assets and intangible assets of the owner, with ownership and intellectual property rights. In the Nanfdan breeding activities, the exchange, loss and escape of breeding materials often occur, leading to substantive infringement.This study analyzed the ownership of breeding materials from various forms of breeding activities, as well as possible violations in practice, with a view to providing a reference for the protection of ownership and intellectual property rights of breeding units and personnel.
