中国种子市场监管现状及优化分析

摘　　要：中国种子市场监管法规体系存在种子经营主体监管全面性差、种子市场准入安全制度不完善、种子市场法律救济制度不健全、种子经销商与种业公司委托关系混乱等一系列问题,导致种子市场杂乱现象频出,给种子产业安全带来威胁。本研究提出可通过提升种子市场监管主体的规范性,完善种子市场监管的中间层结构,建立农民的长效利益机制,解决种子市场主体规范性差的问题;通过完善登记备案法规制度,完善档案法规制度的统一性,完善品种审查法规制度,解决种业准入市场的安全制度问题;通过完善种子事件查处机制,提升执法人员自身责任意识,完善小额诉讼机制,鼓励农民以法规途径维护自身权益,解决种子市场法律救济制度不完善问题;以期通过对种子市场监管法规的不断完善,进一步提升种业市场的核心竞争力,促进中国农业的长久发展。There are a series of problems in the regulatory system of China’s seed market, such as the poor comprehensiveness of the supervision of seed business entities, the imperfect safety system of seed market access, the imperfect legal relief system of the seed market, and the confusion of the entrustment relationship between seed dealers and seed companies, which lead to the frequent occurrence of chaos in the seed market and pose a threat to the safety of the seed industry. This study proposes to solve the problem of poor standardization of the main body of the seed market by improving the standardization of the main body of the seed market supervision, improving the intermediary structure of the seed market supervision, and establishing a long-term benefit mechanism for farmers;The safety system of seed industry access to the market can be solved by improving the registration and filing laws and regulations, improving the unity of the file laws and regulations, and improving the variety review laws and regulations;By improving the mechanism for investigating and dealing with seed incidents, we will enhance the sense of responsibility of law enforcement personnel, improve the mechanism for small claims litigation,encourage farmers to safeguard their rights and interests through laws and regulations, and solve the problem of imperfect legal relief system in the seed market;With a view to further enhancing the core competitiveness of the seed market and promoting the long-term development of China’s agriculture through the continuous improvement of the seed market regulatory laws and regulations.
