屏蔽网站禁令法理探究与规范建构

摘　　要：作为足以和“通知—删除”规则相提并论的重要制度创新,屏蔽网站禁令起源于欧盟,迄今已为四十多个国家接受。该禁令由公权力机关经权利人请求发布,或径行发布,责令信息接入/传输服务提供者屏蔽侵权网站,以有效保护著作权人利益。从规范构成要件及权利基础考察,屏蔽网站禁令当属永久禁令。从禁令起源和制度构成审视,屏蔽网站禁令兼具实体法与程序法双重属性。鉴于我国成文法传统,引入屏蔽网站禁令时,应分别规定实体和程序规则,其中,前者应以《著作权法》第五十三条为依据,在《信息网络传播权保护条例》和《互联网著作权行政保护办法》中作出规定,后者则应作为诉讼特别程序纳入《民事诉讼法》。As an important institutional innovation comparable to the“notice and takedown”rule,the website blocking order originated in the European Union and has been accepted by more than 40 countries so far.The order is issued by public authorities at the request of the right holder,or directly issued by themselves,ordering information access/transmission service providers to block infringing websites in order to effectively protect the interests of copyright holders.From the examination of the normative elements and the basis of rights,the website blocking order is a permanent ban.From the examination of the origin of the ban and system composition,the website blocking order has the dual attributes of both substantive law and procedural law.In view of the statutory law tradition in China,when website blocking order is introduced,the substantive and procedural rules about it should be stipulated separately,among which the former should be stipulated in the Regulation on the Protection of the Right to Network Dissemination of Information and the Administrative Protection of Copyright on the Internet Procedures based on Article 53 of the Copyright Law;the latter should be incorporated into the Civil Procedure Law as a special litigation procedure.
