摘　　要：为明确和落实实验室安全责任、保障实验室安全、发挥法治理念在实验室安全治理能力现代化中的积极意义,该文解读了《民法典》《安全生产法》《教育法》《刑法》等法律法规及司法解释中与实验室安全有关的规定,分析了实验室安全责任中涉及的行为主体、各主体间的法律关系、各自的权力义务和责任,并结合典型实验室安全事故案例探讨了实验室安全涉及的民事、行政、刑事责任,以期为构建高校实验室安全责任体系和完善管理制度提供参考。In order to clarify and implement the responsibility of laboratory safety, ensure laboratory safety, and give play to the positive significance of the concept of law in the modernization of laboratory safety governance capacity, this paper analyzes the behavior subjects involved in the laboratory safety responsibility, the legal relationship between them, and the power as well as the duty of each behavior subject by interpreting the rules in the Civil Code, Work Safety Law, Education Law, Criminal Law and other laws and regulations and judicial interpretations related to laboratory safety. Combined with the analysis of a typical laboratory safety accident, this paper also discusses the civil liability, administrative liability and criminal liability related to the laboratory safety,with the hope of providing reference to build a university laboratory safety responsibility system and to perfect management system.
