摘　　要：政策是法律的重要渊源,政策推动是我国区域经济发展的特色进路。我国区域经济政策内容丰富且已形成规模,但目前区域经济法律供给相对滞后,区域经济政策与法律的关联性尚未理顺,存在将二者割裂对立或混同等误解。法源性区域经济政策是区域经济法制的重要立法资源,对其有效识别与立法转化是健全区域经济法制的重要支撑。法源性区域经济政策的识别可以法属性为核心,从区域经济政策制定主体、实施时间、实施效果、要素结构规范性、可复制性、非冲突性等维度分析提炼。同时,应在明晰法源性区域经济政策转化动力与进路的指引下,以塑造法的基本构成要素为导向进行法律转化,进而形成由地方立法先行到中央层面统摄的区域经济法制格局,促进区域经济协调发展。Policy is an important source of laws,and policy promotion is a characteristic approach to China’s regional economic development.China’s regional economic policies have abundant contents and a considerable scale,but the development of regional economic law lags relatively behind,as the relevance between policies and laws has not been clarified and they are often separated or misunderstood as the same.Since the regional economic policies with legal sources are an important legislation resource of the regional economic legal system,their effective identification and legalization are a key support for improving the legal system of regional economy.The identification can center on their legal attributes and analyze the policy making from the dimensions like subjects,implementation time and effect,the normativeness of element structure,replicability,and non-conflicting nature.The legalization requires clarifying the momentum and path of the policies,and should be oriented toward building basic constitutive elements of laws.Further,the legal system of regional economy can be established,with local legalization carried out beforehand and under unified management of the central government,to promote the coordinated development of the regional economy.
