绿色发展理念下农业生态补偿法律机制的困局与对策

摘　　要：阐述了农业生态补偿法律机制的内涵和现实意义,分析了农业生态补偿法律机制面临着法律体系不够健全、执行标准模糊以及主体对补偿制度认识不足等困境,提出了明确公平公开的补偿原则、加强系统性专项立法、因地制宜优化补偿标准、拓展多元化补偿资金渠道以及建立多方参与的动态监管评估体系等对策,以探寻农业生态补偿机制实践困境的破局之道。The connotation and practical significance of the legal mechanism of the agricultural ecological compensation were expounded,the difficulties of the legal mechanism of the agricultural ecological compensation,such as imperfect legal system,vague implementation standards and lack of understanding of the compensation system,were analyzed,and some measures of clarifying the principle of fair and open compensation,strengthening the systematic special legislation,optimizing the compensation standard according to local conditions,expanding the diversified compensation fund channels and establishing the dynamic supervision and evaluation system with multiple participation were put forward,in order to solve the practical dilemma of agricultural ecological compensation mechanism.
