摘  要:当前,我国的油气管道事故频发,事故发生前的预防和事故发生后的应急处置是降低管道事故损失的重要手段。通过系统梳理我国油气管道突发事件应急法律体系和制度内容发现,目前存在应急预案制度不完善、信息协同制度不完备以及应急监管制度不明晰等制度困境,困境成因在于现行法律体系不完备以及管理体制存在弊端。对此,在考察借鉴美国和加拿大油气管道突发事件应急法律体系和法律制度的基础上,提出如下建议:增加高位阶油气管道应急法律法规与健全低位阶油气管道应急规定,以完善油气管道应急法律体系;从改善我国油气管道应急预案制度、规范突发事件信息报告与共享制度、建立综合权威的应急监管制度等方面优化油气管道应急主要法律制度的内容。As has been predicted, China’s oil and gas pipelines have entered a period of high incidence of accidents, which entail both the prior preventive safeguards and subsequent emergency disposals to minimize the losses. Analysis has suggested that the root cause lies in the loopholes of the current oil and gas pipeline emergency legal system and management regime, which include the inadequate contingency planning, insufficient information coordination, and intransparent emergency monitoring system. Accordingly, referring to the situation of the United States and Canada, we propose improving the oil and gas pipeline contingency management regime by designing upper-rank legislation and amending lower-rank regulations. Practices regarding specific paths include improving China’s oil and gas pipeline contingency management regime, standardizing the emergency information reporting and sharing management system, and establishing a comprehensive and authoritative emergency supervision mechanism.
