摘　　要：《民法典》中知识产权合同的相关规定呈现出意定主义强化趋势,这是民法典体系融贯性要求使然,也是当代知识产权法理念、技术、价值共同作用的结果,具有时代的必然性和适应性,对知识产权立法、司法、执法将产生深远的影响。在当今知识产权全球化的时代,我国需要积极参与国际规则制定,加强国内法律与国际条约的衔接;参考世界银行营商环境评价指标体系,不断完善司法保护和行政执法的体系建设,发挥司法保护的主导作用;在知识产权日益成为国家发展的战略性资源和国际竞争力的核心要素之际,全面促进知识产权权利主体利益、社会公共利益与国家利益的共同发展。The relevant provisions of intellectual property contracts in the Civil Code show the trend of strengthening the autonomy,which results from the integration of the Civil Code system and the joint action of the concept,technology,and value of contemporary intellectual property law.It has the necessity and adaptability of the times and will have a profound impact on the legislation,justice,and administrative law enforcement of intellectual property.In the era of intellectual property globalization,the state should actively participate in the process of establishing international rules and strengthen the connection between domestic laws and international treaties.Referring to the business environment evaluation index system of the World Bank,the state should allow the judiciary to play a leading role in the protection of intellectual property rights.As intellectual property is increasingly becoming the strategic resources of national development and the core elements of international competitiveness,it is necessary to promote the shared development of the interests of the intellectual property rights holders,public interests and national interests.
