负有照护职责人员性侵罪的基本特征与竞合适用

摘　　要：负有照护职责人员性侵罪对负有照护职责人员增加了更严格的审慎约束义务,突出了对已满14不满16周岁未成年女性的特殊保护地位。照护职责人员的身份界定应以行为时建立的职责为准,犯罪对象只具有部分性承诺能力,本罪的实行行为与强奸罪的认定标准保持一致。本罪与强奸罪之间是法条竞合关系,所侵害的法益是未成年女性的性自主权,二者从量刑由低到高有序衔接,共同完善对低龄未成年女性性权利的刑法保护。在司法适用中,负有照护职责人员性侵罪的法定升格刑条件需要结合强奸罪加重情节的认定,在监护职责、犯罪对象跨年龄等因素发生变化时,要注意把握与强奸罪的竞合适用,以便精准打击犯罪,更好地维护低龄未成年女性的性权利。The crime of sexual assault by persons with duty of care adds more stringent binding obligations to persons with care responsibilities,highlighting the special protection status of underage female who have reached the age of 14 but less than 16.The definition of the identity of the person in charge of care should be based on the responsibility for acts.The criminal object only has the ability of partial sexual commitment.The"having sexual relationship"is only limited to the traditional sexual intercourse,which is consistent with the identification standard of the crime of rape.The crime and the crime of rape are the concurrence of legal provisions,and the infringed legal interests are the sexual autonomy of immature female.They progress from low to high sentencing,and jointly improve the sexual ability protection of underage female.In the judicial application,in connection with the identification of the aggravating circumstances of rape,one should specifically grasp the conditions in which the crime constitutes serious circumstances,and pay attention to the competing application with the crime of rape when the factors such as guardianship responsibility and the cross age of the criminal object change,so as to accurately crack down on the crime and better protect the legitimate rights and interests of underage female.
