受控数字借阅的域外实践、版权困境和法律调适

摘　　要：信息时代图书馆的数字化借阅面临与版权冲突的难题,美国图书馆界创造了受控数字借阅方式,通过模拟纸质书借阅流程来实施远程数字化借阅,这有利于保护图书版权。但受控数字借阅在版权上存在合法性的困境,如果将受控数字借阅引入国内,法律需要进行调适,以促进受控数字借阅在国内图书馆推广。从内部调适来说,有必要将受控数字借阅纳入著作权例外情形;从外部调适来说,有必要引入公共借阅权和版权补偿金制度。The digital lending of libraries in the information age is faced with the problem of conflict with copyright. The American library community created a controlled digital lending method, which implements remote digital lending by simulating the paper book lending process, this helps to protect the book copyright. However, there is a legal dilemma in the copyright of controlled digital lending. If controlled digital lending is introduced into China, the law needs to be adjusted to promote the promotion of controlled digital lending in domestic libraries. From the perspective of internal adjustment, it is necessary to include controlled digital lending into the copyright exception;from the perspective of external adjustment, it is necessary to introduce the public lending right and copyright compensation system.
