论拒不支付劳动报酬罪中行政前置的适用

摘　　要：拒不支付劳动报酬罪的成立以劳动行政部门责令用人单位支付劳动报酬为前提。劳动行政部门的责令支付要分两种情况分别确定是否要考虑用人单位的支付能力,并在不同情形中运用相应查实支付能力的方法。在行政前置的适用中,司法机关既要对责令支付的法律文书进行实体审查,确保其认定的支付主体准确、责令支付内容合法、引证法律依据正确;也要从程序上审查责令支付法律文书的作出、送达是否符合规定,有无剥夺用人单位对行政责令行为不服时的行政复议或行政诉讼等权利。The crime of refusing to pay labor remuneration shall be established on the premise that the labor administrative department orders the employer to pay labor remuneration.The pay order of the labor administrative department shall be divided into two situations,by which to respectively determine whether to consider the payment capacity of the employer,and whether to apply the corresponding method of verifying the payment capacity to pay in different situations.The setting of administrative precondition not only allows the workers’right to obtain labor remuneration protected by both administrative law and criminal law,clarifying the sequence of the two department laws in dealing with illegal acts of labor remuneration payment,but also can effectively restrict the criminalization of the acts of refusing to pay labor remuneration by administrative means.In the application of administrative precondition,judicial organs should not only conduct substantive review of the legal documents ordered to pay,ensuring that the identified payment subject is accurate,the content ordered to pay is legal and the legal basis cited is correct;but also conduct procedural review whether the making and service of the legal documents ordered to pay are in compliance with the regulations,and whether the employer is deprived of the right to administrative reconsideration or administrative litigation when it is dissatisfied with the administrative order.
