超大型平台自治规则的备案审查制度研究

摘　　要：确保其自治规则成为“良规”,才能指向超大型平台健康有序发展的“善治”。考察现状,超大型平台自治规则在程序正义与实体正义上皆存在不足和存疑之处。结合具体实践,仅从私法角度和利用司法救济的手段已经难以实现对其完全规制,建立专门的备案审查制度理应成为治理作为“守门人”的超大型平台自治规则的新进路。落实到备案审查的具体机制,合法性与合理性的双重要求构成主要的原则和标准;有件必备,备而后查,主动审查与被动审查相结合是作为基本的结构与方法;主管机关负责,视情况分步采取恰当的方式实现在主体与处理上的安排。基于对超大型平台自治规则的必要尊重,在审查过程中还应当注意把握好具体限度。Only by ensuring that the rules of autonomy become "good rules" can we point to "good governance" for the healthy and orderly development of super-large platforms.Examining the current situation,there are deficiencies and doubts in both procedural justice and substantive justice in the autonomous rules of super-large platforms.Combined with specific practice,it is difficult to achieve complete regulation of it only from the perspective of private law and by means of judicial relief.The establishment of a special filing review system should be a new way to govern the autonomous rules of super-large platforms as the "gatekeeper".For the specific mechanism of filing review,the dual requirements of legitimacy and rationality constitute the main principles and standards;if necessary,prepare for later review,and the combination of active review and passive review is the basic structures and methods;the competent authority is responsible,and takes appropriate steps to realize the arrangement on the subject and processing according to the situation.Based on the necessary respect for the rules of autonomy of super-large platforms,attention should also be paid to grasping the specific limits during the review process.
