论监察机关在引渡诉讼中的职能

摘　　要：监察机关是我国反腐败专门机构。在开展引渡等反腐败国际刑事司法合作中,监察机关履行一定刑事司法职能,应当承担《引渡法》所要求的刑事司法机关引渡诉讼职能。我国《引渡法》应当确立国家监委在引渡合作中主管机关的法律地位。作为引渡诉讼主管机关,国家监委有权以自己名义通过外交部提出引渡请求,需要通缉羁押被请求引渡人的,有权以自己名义通过外交途径或者被请求国同意的其他途径提出。当外交部向被请求国作出有关限制追诉或者量刑的承诺的,应当听取国家监委的意见。对于有关我国刑事司法制度整体评价、特定性原则等问题的承诺,国家监委有权自行作出决定。Supervisory authorities are specialized anti-corruption agencies in China. In carrying out international criminal justice cooperation against corruption, such as extradition, the supervisory authorities perform certain criminal justice functions and should assume the functions of criminal justice organs in extradition proceedings as required by the Extradition Law. China’s Extradition Law should establish the legal status of the National Supervisory Committee as the competent authority-in-charge in extradition cooperation. As the competent authority-in-charge for extradition proceedings, the National Supervisory Committee shall have the right to submit extradition requests in its own name through the Ministry of Foreign Affairs and, if the person sought is wanted for detention, through diplomatic channels or other channels agreed to by the requested State. When the Ministry of Foreign Affairs makes a commitment to the requested State regarding the limitation of prosecution or sentencing, it shall hear the opinion of the National Supervisory Committee. The National Supervisory Committee is entitled to make its own decision on commitments concerning the overall evaluation of our criminal justice system, the principle of specificity, etc.
