关于同性同居伴侣子女抚养权争议的探讨

摘　　要：随着辅助生殖技术应用的增加,出现了同性同居伴侣通过辅助生殖技术生育和抚养子女的情况,并且在司法实践中已经有同性同居伴侣争夺子女抚养权的案件。以目前仍在诉讼程序中的“同性伴侣子女抚养权纠纷案”为基础,探讨了同性同居伴侣共同生养子女的相关问题,并提出了对同性同居伴侣子女抚养权归属的建议。同性同居伴侣在共同抚养子女的过程中,应该充分保护子代权益;发生子女抚养权争议时,建议将儿童利益最大化作为抚养权认定的首要原则;另外,通过“互惠体外受精”的方式生育的同性伴侣,在抚养权认定过程中,未获得抚养权的一方,也有抚养子女的义务和参与子女成长的权利,建议结合子女意愿采取对子女成长最有利的抚养方案。With the application of assisted reproductive technology(ART) is gradually increasing, it is the fact that some same-sex couples have children by using ART and raising them together. In judicial practice, there have been cases that same-sex couples broken up and led to the disputes over the custody of their children. Based on the case " child custody dispute of same-sex couples", which is still under the litigation process, the article analyzed the relative issues involved in child custody of the same-sex couples, and offered some suggestions. On the process of bringing up their children, the same-sex couples should adequately protect the rights and interests of their kids. The principle of the best interests of the child should be the criterion when they encounter the custody disputes. In addition, if same-sex couples have had their offspring through the ROPA(reception of oocytes from partner), during the process of custody determination, the one who has not been awarded custody also have the obligation to raise children and the right to participate in children’s lives. It is also recommended that considering children’s own wishes would be better to make a most beneficial plan for their growth.
