摘　　要：医学教科书作为证据适用存在一定争议,民事诉讼中法官对其是否属于法定的证据种类及证明力大小的态度不一,差异性较大。以中国裁判文书网138份判决书为研究对象,梳理法官对医学教科书作为证据适用的情况,论证医学教科书具备民事证据属性,并提出其作为证据适用的基本规则。There is considerable controversy about the application of medical textbooks as evidence.In civil litigation,judges have different attitudes about whether they can be used as evidence,and the differences are large.Taking the 138 judgments of China Judgment Document Network as the research object,sorting out the application of medical textbooks as evidence,this paper demonstrated that medical textbooks have the attributes of evidence,and to propose basic rules for their application as evidence.
