摘　　要：平台经济犯罪治理应以平台责任为中心,实现从"避风港"到"看门人",从单方治理到合作共治的转变.在解释立场方面,应以实质解释为基础,实现从"单一主体"到"多元主体",从"概念"到"类型",从"结果导向"到"路径导向"的转型.在解释规则方面,应基于范式性强弱调整语义位阶,增强刑法规范的回应性;应注重解释的外部性,将技术中立与刑事政策因素纳入解释过程;应采主体间性的解释模式,确保平台及用户充分参与刑事诉讼.The governance of platform economic crimes should take platform responsibility as the center,and realize the transformation from“safe haven”to“gatekeeper”,from unilateral governance to co-governance.In terms of interpretation position,substantive interpretation should be the basis to realize the transformation from“single subject”to“multiple subject”,from“concept”to“type”,from“result oriented”to“path oriented”.In terms of interpretation rules,in order to enhance the responsiveness of criminal law norms,semantic level should be adjusted according to the strength of paradigm.We should pay attention to the externality of interpretation,bring technology neutrality and criminal policy into the process of interpretation.Intersubjective interpretation mode should be adopted to ensure that platforms and users fully participate in criminal proceedings.
