元宇宙空间的数字版权治理:创新价值、制度困境与调适

摘　　要：元宇宙是媒介的革命,其带来的虚拟和现实交融为人类构建了新的发展场景,拓展了人类活动的维度空间。元宇宙空间特殊的社会形态和技术形态对版权的生产与消费产生多重影响。从创新价值上看,元宇宙促进了数字版权公共服务政策目标的实现,有利于数字版权的有效保护和利益的合理分配,从而优化了版权的生产与消费结构。但也面临虚拟现实作品类型定性难题,针对文本与数据挖掘、临时复制等是否构成合理使用的制度不确定性,以及虚拟现实空间作品来源认定难及其引发的侵权风险。当前可以从确定虚拟现实作品为视听作品,对文本与数据挖掘、临时复制适度扩张为合理使用,采取包容审慎的数字版权监管原则三个方面进行相应的法律规制,促进元宇宙下数字经济的发展,落实“以虚促实”的国家政策。The metaverse is the revolution of media,which brings the blending of virtual and reality,constructs a new development scene for mankind and expands the dimensional space of human activities. The special social and technological forms of metaverse space have multiple effects on the production and consumption of copyright.From the perspective of innovation value,metaverse promotes the realization of policy objectives in the public service of digital copyright,provides effective protection for digital copyright and realizes the rational distribution of interests,optimizing the production and consumption structure of copyright. However,it also faces the qualitative problems of the classifying virtual reality works,the institutional uncertainty of whether text and data mining and temporary reproduction constitute reasonable use,and the infringement risk caused by the problem in identifying the source of virtual reality space works. At present,we can determine that virtual reality works are audio-visual works,appropriately expand text and data mining and temporary reproduction for rational use,and adopt the inclusive and prudent digital copyright supervision principles to carry out corresponding legal regulations,so as to promote the development of digital economy in the metaverse and implement the national policy of “promoting reality with virtual”.
