摘　　要：人工智能的问世并快速发展,必然涉及人工智能生成成果的保护问题。随之而来的是这一问题对著作权法的冲击,即人工智能能否成为著作权主体,其生成成果是否具有可作品性,如果符合作品构成要件,又该如何确定该生成成果的权利归属等。为了促进人工智能生成成果的创作和应用,应该承认其可作品性,但面对质疑,首先,需要确认人工智能的所有人和使用者才是适格的著作权主体,不应该是人工智能本身;其次,人工智能具有创作能力,实施了创作行为,其生成成果具有独创性,符合作品构成要件;最后,确认人工智能生成成果具备可作品性后,不仅要从法理学角度明确其合法性,而且需要论证其著作权归属及保护方式。A few years ago, AlphaGo defeated Lee Se-dol who is the world′s top Go player, the explosion news has attracted widespread attention to artificial intelligence from all sectors of society. The advent and rapid development of artificial intelligence will inevitably involve the protection of the generated results by artificial intelligence. The impact of this problem on copyright law is whether Artificial intelligence can become the subject of copyright, whether the results generated by it are workable, and if it meets the requirements of the work, how to determine the right ownership of the achievement. To promote the creation and application of AI-generated results, we should recognize that it meets the conditions to constitute the work, but in the face ofquestions, first of all, it needs to be confirmed that the owners and users of AI are the appropriate copyright subjects, and should not be AI itself. Secondly, artificial intelligence has the creative ability. It not only carries out the creative behavior, but also its creation results are originaland meet the constituent requirements of the work. Once again, after confirming that the artificial intelligence achievements meet the composition condition of the work, we should not only clarify its legitimacy from the perspective of jurisprudence, but also need to demonstrate the copyright ownership and protection methods.
