摘　　要：通过对医患双方自愿协商、人民调解、行政调解和诉讼四种医疗纠纷解决方式的比较分析,发现我国现有医疗纠纷解决方式存在的主要问题是:卫生行政部门在解决医疗纠纷上缺位,未能充分发挥作用。中共中央、国务院提出要强化行政机关解决同行政管理活动密切相关的民事纠纷功能,发挥行政裁决化解民事纠纷的“分流阀”作用。医疗纠纷与卫生行政管理活动密切相关且专业性强。在中共中央、国务院对行政裁决新定位的背景下,将行政裁决设立为医疗纠纷的解决方式,是落实党中央探索扩大行政裁决适用范围的优先事项。文章分析了以行政裁决方式解决医疗纠纷的必要性,提出了以行政裁决方式解决医疗纠纷的现实路径。It was found that the main problems existing in the medical dispute settlement methods in China were the absence of health administrative department in solving medical disputes and unable to give full play to its role by comparative analysis of voluntary consultation between doctors and patients,people's mediation,administrative mediation and lawsuit.The CPC Central Committee and The State Council has proposed to strengthen the function of administrative departments to resolve civil disputes closely related to administrative activities,and play the role of administrative adjudication as a"diversion valve"to resolve civil disputes.Medical disputes are professional and closely related to health administration activities.Under the background of the CPC Central Committee and The State Council's new positioning of administrative adjudication,the establishment of administrative adjudication as the solution of medical disputes is a priority to exploration of expanding the application scope of administrative adjudication.The necessity of resolving medical disputes by administrative adjudication was analyzed,and the realistic path of resolving medical disputes by administrative adjudication was put forward.
