摘　　要：《传染病防治法》第38条确立了传染病疫情信息公布制度,并提出“及时、准确”的基本要求。以公众知情权为理论根基的传染病疫情信息公布制度具备宪法基础与实践规范支撑,但过高的公布主体门槛以及授权发布的程序设置使其无法因应疫情防控实践需求。“及时、准确”要求疫情信息公布既要回应疫情信息的强即时性,又要遵循真诚、善良的诚实信用原则。因此,可从明确“及时、准确”的具体指向出发,将疫情信息公布“事先审查”改为“事后复核”,并确立疫情信息的分类分级发布机制,适当放宽公布主体的范围。同时,辅之以疫情信息公布的过渡措施。Article 38 of the"Law on the Prevention and Control of Infectious Diseases"establishes a system for disclosing information on infectious disease epidemics,and puts forward the basic requirements of"timely and accurate".The information disclosure system of infectious diseases based on the public's right to be informed is theoretically supported by constitutional foundations and practical norms,but the high threshold of disclosure subjects and the procedures for authorized publication makes it impossible to meet the practical needs of epidemic prevention and control."Timely and accurate"requires that the release of epidemic information should not only respond to the strong immediacy of epidemic information,but also follow the principle of sincerity and good faith.Therefore,starting from the specific direction of"timely and accurate",the"pre-review"of the publication of epidemic information can be changed to"post-review",a classified and grading release mechanism of the epidemic information can be established,and the scope of the announcement subjects can be appropriately relaxed.At the same time,it is supplemented by transitional measures for the release of epidemic information.
