目的论视角下监狱计分考核制度的时空阻隔式改革

摘　　要：服刑人员作为追求自身利益最大化的理性主体积极参与计分考核制度以获得减刑、假释为终极目的,这是因为计分考核结果是减刑、假释程序流转中最重要的证据材料。因此规范减刑、假释程序首先应当保证计分考核结果的真实性,但不能只从担当最后一道防线的审理程序入手,而应当在根源上对计分考核制度本身进行改造,使其更加科学合理。时空阻隔式改革可以实现监狱干警与服刑人员的空间隔离和监狱干警、服刑人员与计分考核结果的时间隔离,辅之检察机关的检察监督,可以有效保证减刑、假释程序中流通的证据材料的真实性,防范司法腐败。The maximum rational subject actively participates in the scoring assessment system to obtain commutation and parole as the ultimate goal,because the scoring assessment result is the most important evidence material in the circulation of commutation and parole procedures.Therefore,to standardize the procedures for commutation and parole,we should first ensure the authenticity of the results of the scoring assessment,but we should not only start with the trial procedures that serve as the last line of defense,but should reform the scoring assessment system itself to make it more scientific and reasonable.The space-time barrier reform can realize the spatial separation of prison officers and prisoners,and the time separation of prison officers,prisoners and scoring assessment results,and the pro curatorial supervision of the pro curatorial organs can effectively ensure the authenticity of the evidence materials circulating in the commutation and parole procedures.sex and prevent judicial corruption.
