摘　　要：以2002年到2021年法院受理的2142起档案纠纷案件为样本,分析当前法院审理档案案件的现状与困境。实证研究显示,档案纠纷分为了行政、民事、刑事、国家赔偿四种。立案登记制实施以后,档案案件日益增多,档案行政行为存在不规范现象,档案主管部门执法乏力,行政、民事赔偿案件中原告举证困难,档案行政执法与刑事司法衔接不畅等问题频发。未来,应当健全立案登记制,强化诉源治理;规制档案主管部门不当行为,纠正行政不作为;健全执法监督机制,完善联合执法机制;提升档案查询服务水平,保障当事人查档取证的权利;解决用人单位失档扣档问题;完善行刑衔接机制,准确打击档案刑事犯罪。Taking the 2142 archival dispute cases accepted by the court from 2002 to 2021 as a sample, the current situation and dilemma of the court’s trial of archival cases are analyzed.Empirical research shows that archival disputes are divided into four types: administrative, civil, criminal, and state compensation.After the implementation of the case filing and registration system, the number of archival cases has been increasing, there are irregularities in archival administrative acts, the law enforcement of the competent archival departments is weak, the plaintiffs have difficulty in presenting evidence in administrative and civil compensation cases, and the connection between archival administrative law enforcement and criminal justice is not smooth.In the future, the case filing and registration system should be improved, and the governance of the source of litigation should be strengthened;the improper conduct of the competent departments for archives should be regulated and administrative inaction corrected;the law enforcement supervision mechanism should be improved and the joint law enforcement mechanism should be improved;the level of file inquiry services should be improved to ensure the rights of parties to check files and collect evidence;the problem of employers losing files and fastening files should be solved;and the mechanism for linking executions should be improved to accurately crack down on criminal crimes in archives.
