摘　　要：本文写作背景为新冠肺炎爆发以来,为保障国家安全、社会稳定、人民生命健康安全,国家在防疫政策制订、执行时由于法律规范不健全,导致行政职权混乱无序,致使出现少数防疫工作人员在按照防疫政策执行时损害公民权利的问题。本文写作目的在于,探讨在后疫情时代如何在做好防疫工作的同时,在公民权利的保护上进行一些思考和提供对策及建议。本文第一部分,对主要概念公民权利进行简单的介绍。第二部分是主要对国外一些国家的疫情的基本情况进行阐述,通过相关数据分析各国采取的防疫政策,特别对我国采取的防疫政策进行了总结,并结合实际论述了相关政策对防疫的现实意义。第三部分介绍了我国在防疫政策执行中遇到的主要问题,包括立法滞后问题、法律研究滞后问题、防疫中的行政执法问题,最终将问题聚焦于公民权利的保护问题上。第四部分对前文提出的问题做了简要分析及思考,并结合我国的实际情况提出了具体的对策和建议。The background of this paper is that since the outbreak of COVID-19,in order to ensure national security,social stability and people’s health and safety,the imperfect legal norms in the formulation and implementation of national epidemic prevention policies have led to the disorder of administrative functions and powers,which has caused the epidemic prevention staff to damage the civil rights when implementing the epidemic prevention policies.The purpose of this paper is to discuss how to do a good job in epidemic prevention in the post-epidemic era as well asto think about and provide countermeasures and suggestions on the protection of civil rights.The first part of this paper mainly makes a brief introduction of the main concept of civil rights.The second part mainly expounds the basic situation of epidemic situation in some foreign countries,analyzing the epidemic prevention policies adopted by various countries through relevant data,especially summarizing the epidemic prevention policies adopted by China,and discussing the practical significance of relevant policies on epidemic prevention in combination with the actual situation.The third part introduces the main problems encountered in the implementation of epidemic prevention policy in China,including lagging legislation,lagging legal research and administrative law enforcement in epidemic prevention,and finally focuses on the protection of civil rights.The fourth part makes a brief analysis and reflection on the problems mentioned above and puts forward specific countermeasures and suggestions in combination with the actual situation of our country.
