摘  要:蒲松龄用毕生精力创作的《聊斋志异》有着“全公案小说史的‘龙头’”之称。他用志怪的浪漫奇幻手法,撰写出《胭脂》《席方平》等许多脍炙人口的公案小说名篇,塑造出诸如施愚山、石宗玉、费祎祉等许多仁智儒雅的清官形象,虽然其中一些内容描写的是阴间之事,但仍是对现实世界的种种映射和思考。通过对这些清官的描写,展现了蒲松龄对明末清初黑暗封建社会的抨击,对司法不公的批判,以及对公平正义的渴望,同时,也体现出底层百姓对理想清官的渴盼。作为中国传统法律文化的一个重要组成部分,“清官法律文化”对我国当代法治建设既有积极作用,也有一定的消极影响。唯有合理辩证地对待“清官法律文化”,方能使其在我国法治现代化建设中熠熠生辉。Strange Stories from a Chinese Studio,written by Pu Songling with all his life,is known as the“leader”in the history of all fictions about legal cases.He wrote many well-known detective novels,such as Rouge and Xi Fangping,by describing ghosts and demons,and created many honest and upright official images,such as Shi Yushan,Shi Zongyu and Fei Yizhi.Although some of them described things in the underworld,they are still various mappings and reflections of the real world.Through the description of these honest officials,it shows Pu Songling's attack on the dark feudal society in the late Ming and early Qing Dynasties,his criticism of judicial injustice,and his desire for fairness and justice.At the same time,it also reflects his beautiful yearning and pursuit of ideal honest and upright officials.As an important part of Chinese traditional legal culture,the“honest official legal culture”has both positive and negative effects on the construction of the contemporary rule of law.Only with a reasonable and dialectical perspective on the“legal culture of honest officials”can make it shine in China's legal modernization.
