摘　　要：沉浸式剧本娱乐作品是新的作品形式,其中存在设计、规则、剧情、人设、人物关系、道具等多种作品元素,作品整体为上述元素有机构成的系统,具有复合性。沉浸式剧本娱乐作品可能基于原创剧本产生,亦可能是改编的产物。不论何种情形,作品创作都应以尊重他人著作权为前提。沉浸式剧本娱乐作品之间可能侵权,亦可能侵犯其他类型作品的著作权;可能构成整体侵权,亦可能构成部分侵权;可能侵犯复制权、演绎权,亦可能构成不正当竞争行为。欲保证沉浸式剧本娱乐行业的有序竞争和健康发展,须对设计、规则、剧情、人设及人物关系等作品的非文字性元素提供权利或权益保护,辅以反不正当竞争法的补充保护。在司法裁判中,应结合思想表达两分法、原创性原则、版权侵权判定标准及合理使用规范综合对个案进行裁判,力图实现版权保护与创造自由之间精妙的平衡。Immersive scripted entertainment works is a new form of work,in which there are various elements of works such as design,rules,plot,human characters,character relationships,props,etc.,and the works as a whole are organically composed systems of the above elements and are composite in nature.Immersive scripted entertainment works may be based on the original script,or may be the product of adaptation.In any case,the creation of the work should be based on the premise of respecting the copyright of others.Immersive scripted entertainment works may infringe on each other or on the copyrights of other types of works;they may constitute overall infringement or partial infringement;they may infringe on the right of reproduction and interpretation or constitute unfair competition.In order to ensure the orderly competition and healthy development of the immersive scripted entertainment industry,it is necessary to provide protection for the rights or interests of non-literal elements of works,such as design,rules,plot,persona and character relationships,etc.Such protection is mainly under the framework of copyright law,supplemented by the protection of anti-unfair competition law.In judicial adjudication,cases should be adjudicated by combining the dichotomy of ideas and expressions,the principle of originality,the criteria for determining copyright infringement and fair use norms,in an attempt to achieve a delicate balance between copyright protection and freedom of creation.
