摘　　要：当前计算机技术的不断更新迭代,移动互联网络的不断发展,极大地方便了人们的日常生活,使得“秀才不出名,便知天下事”成为现实,网络已经逐渐成为了人民群众了解世界、发表言论的主要渠道。网络的优势给人们带来便捷的同时,也逐渐产生了一些不容忽视的问题,其中以网络散播谣言的现象最为常见。谣言传播本身制作成本低廉、社会影响较为恶劣,极大地侵害了公民的合法权益,甚至还在一定程度上对公共秩序造成危害。在对网络谣言进行治理时,由于相关法律法规的薄弱环节以及刑法中对网络行为的不适用,使得治理网络谣言出现困难。因此如何切实可行地防控网络谣言,杜绝谣言犯罪已经逐渐成为当前亟待解决的问题。梳理刑法中对网络谣言的相关界定,汇总其他国家法律中针对网络造谣的具体标准,在总结成功经验的基础上,剖析其与普通刑事犯罪的区别,提出有效防治网上造谣犯罪的刑事司法措施,能够进一步激发司法机关的能动性,为相关从业人员提供借鉴和帮助。With the continuous updating of current computer technology and the development of mobile Internet, it has greatly benefitted people’s daily life, and made it a reality that “scholars know the world without being famous”. The Internet has gradually become the main channel for people to understand the world and express their opinions. While the advantages of the Internet bring convenience to people, there are also some problems that can not be ignored gradually, among which the phenomenon of spreading rumors on the Internet is the most common. Rumor propagation itself has low production cost and bad social impact, which greatly infringes the legitimate rights and interests of citizens and even harms public order to a certain extent. When dealing with Internet rumors, it is difficult to deal with Internet rumors due to the weak links of relevant laws and regulations and the inapplicability of Internet behaviors in criminal law. Therefore, how to effectively prevent and control network rumors and put an end to rumor crimes has gradually become an urgent problem to be solved. Through the relevant definition of Internet rumors in criminal law, the specific standards for Internet rumor mongering in all other countries’ laws are summarized. On the basis of summarizing successful experience, the differences between Internet rumor mongering and ordinary criminal crimes are analyzed, and criminal judicial measures for effective prevention and treatment of online rumor mongering are proposed, which can further stimulate the initiative of judicial organs and provide reference and help for relevant practitioners.
