摘 要:2020年《中华人民共和国著作权法》(下称《著作权法》)通过了立法以来的第三次修订(下称“修法”),回应了实践中的多方诉求。然而,该法修改后,“反公地”现象在实践中依然存在。近期一起电视剧著作权纠纷案(以下简称“著作权纠纷案”)中的“反公地悲剧”就暴露出两个法律瑕疵,即“免责瑕疵”和“赔偿认定瑕疵”。要解决此类问题,需基于新的发展理念,平衡好权利保护和产业繁荣两方面的目标,尝试建立新的权利救济方式和授权模式。In 2020, the “Copyright Law of the People’s Republic of China”( hereinafter referred to as the “Copyright Law”) was revised for the third time since its enactment(hereinafter referred to as “Revised Law”), responding to various demands in practice. However, after the law was amended, the “anti-commons” phenomenon still exists in practice. Taking a recent TV drama copyright dispute case(hereinafter referred to as the “copyright dispute case”) as an example, the article analyzes the “tragedy of the anti-commons” in the case and the two legal flaws that were exposed, namely the “exemption flaw” and the “compensation determination” flaw. It is proposed that to solve this problem, it is necessary to balance the goals of rights protection and industrial prosperity based on new development concepts, and try to establish new rights relief methods and authorization models.
