保护外卖送餐人员因工致伤保险问题简析

摘　　要：近年来,外卖行业发展迅速,从事外卖送餐的人员也在不断增多。外卖和其他职业有所不同,他们更加追求时效,主要工作就是来回穿梭于商家和点餐人之间,在外卖行业快速发展的同时,外卖送餐人员在送餐路上所发生的交通安全事故频率也在不断上涨。对于外卖送餐人员来说,工伤保险可以为他们保护自己的合法权益提供保障。就目前来看,受到外卖送餐人员流动较大、工伤认定困难等多种因素的影响,很多外卖送餐人员并没有享受工伤保险所带来的福利,取而代之的是商业保险,但是商业保险无论是保障范围还是力度都比较小。在此背景下,对保护外卖送餐人员因公致伤保险问题展开分析研究,将外卖送餐人员划分到工伤保险范围内,创建外卖送餐人员工会,做好外卖送餐人员安全教育工作,进一步完善外卖送餐职业保险等,是保障外卖送餐人员的合法权益、推动我国外卖行业规范和长远发展的必然选择。In recent years, the take-out industry has developed rapidly, and the number of people engaged in takeout delivery is also increasing. Different from other professions, takeout is more timely. Their main job is to travel back and forth between merchants and diners. With the rapid development of the takeout industry, the frequency of traffic accidents on the delivery road is also increasing. For food delivery workers, industrial injury insurance can protect them to protect their legitimate rights and interests. However, at present, due to the influence of various factors such as the large turnover of food delivery personnel and the difficulty in determining industrial injury, takeout delivery personnel do not gain the benefits brought by work-related injury insurance. Instead, they are replaced by commercial insurance, but the scope and strength of commercial insurance are relatively small. In this context, it is an inevitable choice to analyze and study the issue of insurance for the protection of takeaway delivery personnel for injuries caused on business, divide the takeaway delivery personnel into the scope of industrial injury insurance, create a labor union for takeaway delivery personnel, do a good job in the safety education of takeaway delivery personnel, further improve the occupational insurance for takeaway delivery, etc.,which may guarantee the legal rights and interests of food delivery personnel, and promote the standardization of Chinese food delivery industry and long-term development.
