从律师中选任法官制度的实践与思考

摘　　要：从律师中选任法官作为司法体制改革的重要内容,对于推进法官职业化建设,构建法律职业共同体具有重要意义。然而,考察最高人民法院及浙江、山东、广东等地法院从律师中选任法官的实践发现,从律师中选任法官整体情况并不理想,受制于制度设置的非常态化、价值认知的存在偏差和配套机制的非有效支撑等层面的原因,该项制度至今依然处于“试点运行”阶段且存在着效果不理想、价值偏离、方法缺位等现象。基于此,分别从为什么从律师中选任法官、从律师中选任法官的价值取向和从律师中选任法官的方法论指引三个方面进行法理反思并进行制度设计,从而为从律师中选任法官提供更为深厚的理论基础和建构规范,最大限度地激发制度功能实现的内生动力和创造活力。As an important part of judicial system reform,selecting and appointing judges from lawyers is of great significance for promoting the professional construction of judges and constructing legal professional community.However,investigating the practice of the Supreme Court and the courts in Zhejiang,Shandong and Guangdong Provinces,it is found that the overall situation of selecting judges from lawyers is not ideal.Subject to the abnormal system setting,the serious deviation of value recognition and the ineffective support of supporting mechanism,the system is still in the stage of"pilot operation",and there are some phenomena such as unsatisfactory effect,deviation of value and absence of methods.Based on this,this paper carries out legal theory reflection and system design from three aspects:why to select judges from lawyers,the value orientation of selecting judges from lawyers and the methodological guidance of selecting judges from lawyers,so as to provide a deeper theoretical basis and construction norms for selecting judges from lawyers,and stimulate the utmost endogenous power and create vitality of the system function realization.
