摘　　要：提供虚假证明文件罪是规制中介组织人员出具证明文件失范行为的核心罪名。该罪的罪状表述同时具有繁复不简约和模糊不明确两种缺陷,不符合刑法的明确性和概括性要求。提供虚假证明文件罪的主体不断拓展,已开始突破该罪的典型样态及规制目的。行政犯在立法技术上适合选择空白罪状模式,以保证行政犯的稳定性与灵活性。提供虚假证明文件罪作为行政犯,其立法技术应由叙明罪状转为空白罪状。“中介组织”这个概念在我国现有法学体系下具有规范性、确定性和适当的开放性,符合法律规范概念的一般要求,可继续使用。提供虚假证明文件罪侵犯的是市场经济中中介组织人员的职业信用。以法律系统论为理论支撑,可以尝试构建妨害信用的罪名体系,以助力现代诚信社会建设。The crime of providing false testifying papers is a core charge against misbehaviors of members in intermediary organizations in issuing testifying papers. The description of such offence in the legal text has two defects— complexity without simplicity and ambiguity without clarity, thus fails to meet the requirements of clarity and generality of the criminal law. The scope of perpetrators of the crime of providing false testifying papers has been expanding, which goes beyond its typical pattern and regulatory purpose. It’s suitable to adopt the mode of blank for an administratine crime so as to maintain its stability and flexibility. The crime of providing false testifying papers is an administratine crime, thus, in terms of legislative technique, the legal text should be written from the mode of detailed description to the mode of blank facts. The concept of “intermediary organizations”, which enjoys standardization, certainty and suitable openness under the existing jurisprudence of China, meets the general requirements of a concept in legal norms and thus can be still adopted. The crime of providing false testifying papers infringes upon the occupational credit of members of intermediary organizations in the market economy. It is advisable to try to establish a system of charges against conducting infringing upon credit by taking the theory of legal system as the theoretical support, so as to contribute to the construction of modern integrity-oriented society.
