摘　　要：放活农村土地经营权旨在通过市场机制高效利用农村土地资源,实现乡村振兴。自《中华人民共和国农村土地承包法》确认土地经营权的独立性以来,以土地经营权交易为内容的土地经营权市场得到了进一步发展。土地经营权市场与一般商品市场相同,会因市场失灵而扰乱自身市场秩序,降低市场配置效率。同时,土地经营权市场失灵的发生还会引起社会、生态方面的公共利益受到损害。为此,需要针对目前我国土地经营权市场法律规制存在的问题,完善维护土地经营权市场秩序、提高市场配置土地资源效率的一般目的规制制度,并根据保障粮食安全、生态安全和保护农民利益的要求,完善土地经营权市场特殊目的规制制度。The purpose of delegating rural land management rights is to achieve rural revitalization through the efficient use of rural land resources with the help of market mechanisms.Since Rural Land Contracting Law confirms the independence of land management rights,the land management rights market with the transaction of land management rights has been further developed.Just as the general commodity market,the land management rights market can disrupt its own market order and reduce the efficiency of market allocation due to market failures.At the same time,the occurrence of land management rights market failures will also cause the damage to the social and ecological public interests.Therefore,it is necessary to improve the regulation systems for the general purpose,which is to maintain the market order of the land management rights and improve the efficiency of the market land resources allocation.And the regulation systems of land management market for special purpose should also be improved according to the requirements of ensuring food security,ecological security and protecting farmers’interests.
