摘 要:在全球化背景下,公平是各国求同存异与合作互利的基础,也是国际法的重要价值,公平的实现是国际法价值在内容和逻辑上得以体系化的前提。和平与发展是国际化的显性价值,没有公平发展的和平只能是消极的和平而非持久的和平,只有解决国际发展问题,人类才能从消极和平迈向积极和平。公平和正义是以文化同质性为基础的隐性价值,其中正义是人类法律的终极价值,而公平和效率等次级价值是正义大厦的主要支柱。国际法的显性价值和隐性价值之间的冲突日趋明显,从消极和平到全球正义是国际法发展的必然趋势。国家之间发展的公平化、国际市场效率的公平化以及可持续发展的代际公平,都将沿着传统安全到非传统安全的进路推动和平到正义的价值变革,以此实现人类从野蛮状态下的原始安全到和谐状态下的普遍安全的过渡,这种安全共同体依赖于“人类”主体性的萌芽。中国提出的人类命运共同体理念有利于通过“人类”主体性构建公平正义的国际秩序,为促进世界的和平与发展提供新方案。Against the background of globalization,fairness is the basis for all states to seek common grounds while reserving differences and cooperate for mutual benefits,and also a major value of international law,the realization of which acts as premise for substantive and logic systemization of the values of international law.Peace and development are the explicit values of international law,and peace without fair development is not so much negative peace as lasting peace.Fairness and justice are tacit values based on cultural homogeneity,in which justice is the ultimate value of human law,and secondary values such as fairness and efficiency are the main pillars of the pyramid of justice.The conflict between the explicit and tacit values of international law is becoming increasingly visible and obvious,and transition from negative peace to global justice is an inevitable trend for the development of international law.Equitization of development among states and equitization of efficiency for international markets,and intergenerational equity of sustainable development,will all contribute to the progress of the value of international law from peace to justice along the path from traditional security to non-traditional security.Only in this way will the primitive security of mankind in a jungle context develop into universal security in a harmonious state,and this security community rests on the birth of “human” subjectivity.The concept of a community with a shared future for mankind initiated by China is conducive to building a fair and just international order through the subjectivity of “human” and proposes new solution to maintain world peace and development.
