新修订《体育法》的立法评析、立法创新及重点配套立法完善

摘　　要：运用文献资料法、比较法、逻辑分析法等,对新修订《体育法》进行立法评析,并剖析新修订《体育法》的重要立法创新,就新修订《体育法》实施所需进行的重要后续配套立法进行了探索。新修订《体育法》较1995年《体育法》而言,各章进行了全面而系统的修改。其中体育权利体系的构建、全民健身战略的法定化、学生体育活动意外伤害保险机制和体育学业水平考试制度的建立、体育仲裁制度的建立、体育市场管理体系和体育行政执法体系的规定、高危险性体育赛事活动监管体系的建立、国家体育主权意识的觉醒等都是新修订《体育法》的重要立法创新。为全面实施新修订《体育法》,我国还应进行配套性立法,建议尽快制定《职业体育条例》《体育市场管理条例》等法规规章,让一些制度创新尽快落地实施。Based on the methods of literature review, comparison and contrast, and logical analysis, the study comprehensively interprets and evaluates the new Sport Law, analyzes the important legislative innovations of the new Sports Law, and explores the important follow-up supporting legislation required for the implementation of the new Sports Law. The study found that all the chapters of the new Sports Law have been revised comprehensively and systematically compared to the 1995 Sports Law. Important legislative innovations in the new Sports Law includes the construction of the sports rights system, the legalization of the national fitness strategy, the establishment of the accidental injury insurance policy for students′ sports activities and the examination system for sports competency, the building of the sports arbitration system, the provisions of the sports market management system and the sports administration law enforcement system, and the construction of the supervision system for high-risk sports events, and the sports anti-sanction rules. In order to fully implement the new Sports Law, China should also carry out supporting legislation, and it is recommended to formulate important supporting legislation such as the Professional Sports Regulations, Sports Market Management Regulations.
