摘　　要：构建适应当今中国科技创新需要的科技法律体系,既是法治国家建设的应有之义,也是科技创新发展的内在要求。新修订实施的科技进步法全面强化了其科技基本法的科技法治导向与指引功能,但当今科技创新内外环境决定了科技法律关系的多样性,非功能协调、内容互补的科技法律体系难达其功。因为科技创新体系内外诸因素的影响,中国既有科技法律效用存在诸多有待完善之处。为适应新发展格局下科技创新的法治需要,中国科技创新法律需要从科技创新活动的自身规律入手,有效完善科技法律的体系性和协调性、强化科技法律的现实规范功能,构建适应新时期科技强国建设需要的科技创新法律体系。Building a scientific and technological legal system that meets the needs of China’s scientific and technological innovation is not only the due meaning of the construction of a country ruled by law,but also the internal requirement of the development of scientific and technological innovation.The newly revised and implemented science and technology progress law has comprehensively strengthened the guidance and guidance function of the science and technology basic law.However,today’s internal and external environment of science and technology innovation determines the diversity of science and technology legal relations,and the science and technology legal system with non functional coordination and complementary content is difficult to achieve its success.Due to the influence of various factors inside and outside the scientific and technological innovation system,there are many aspects to be improved in the existing legal effectiveness of science and technology in China.In order to meet the legal needs of scientific and technological innovation under the new development pattern,China’s scientific and technological innovation law needs to start with the laws of scientific and technological innovation activities,effectively improve the systematicness and coordination of scientific and technological law,strengthen the practical normative function of scientific and technological law,and build a scientific and technological innovation legal system to meet the needs of building a strong country with science and technology in the new era.
