摘 要:在公法领域,人们经常使用请求权这一法律术语。请求权可以分为公法请求权与私法请求权,公法请求权这一概念来源于私法请求权,但是有其自身的特色。公法请求权与公法权利这两个概念的运用经常会出现在司法实践与学术讨论中。关于这两者关系,学界主要有三种观点:公法请求权是公法权利的一种权利类型;公法请求权是建立在公法权利基础之上的权利;公法权利就等于公法请求权。从行政法律关系的角度看,人民对于国家所主张的公法权利就是公法请求权。Two concepts, the right in public law and the right to petition in public law, are always used in the field of public law. As far as the relevance between these two concepts, three key opinions are in the mainstream among the current academic circles:(i) the right to petition in public law is a type of right among many kinds of right in public law;(ii) the right to petition in public law is established on the basis that the people have the right in public law;and(iii) the right to petition in public law is equal to the right in public law. If we merely view this problem from the view of administrative legal relationship, for example in the welfare administration, the right in public law which the people claim to the state is just their right to petition in public law.
