基于医疗损害责任纠纷案件的查对制度问题分析与建议

摘　　要：目的分析因查对制度落实不到位引发的医疗损害责任纠纷案件,了解查对制度落实现状并提出建议,为进一步提高医疗质量提供参考。方法以“查对制度”为关键词,通过中国裁判文书网检索2011年1月1日-2021年12月31日与查对制度落实不到位相关的38例医疗损害责任纠纷案件,进行实证分析。结果与查对制度落实不到位相关的医疗损害责任纠纷案件整体呈逐年上升趋势,在2019年达到顶峰,自2020年以后有所下降,但仍处于较高水平。与查对制度落实不到位的医疗损害责任纠纷案件以三级医院为主(44.74%),以药物查对落实不到位居多(73.68%)。结论医院应重视查对制度落实情况,从培训、文化、信息化以及患者参与等多维度制定干预措施,以提高执行力。Objective To analyze the medical damage liability dispute cases caused by the inadequate implementation of the inspection system,understand the implementation status of the hospital inspection system and put forward suggestions,so as to provide reference for further improving the medical quality.Methods With the keyword"inspection system",empirical analysis was carried out by collating 38 medical injury liability dispute cases related to the inspection system in the China Judgment Document Network from January 1,2011 to December 31,2021.Results The cases of medical damage liability disputes related to the inadequate implementation of the inspection system showed an increasing trend year by year,reaching the peak in 2019,and decreased after 2020,but still at a high level.The majority of medical damage liability dispute cases were tertiary hospitals(44.74%),and the majority were drug investigation cases(73.68%).Conclusion Hospitals should attach importance to the implementation of the inspection system,and formulate measures from the aspects of training,culture,information and patient participation to strengthen the implementation of the inspection system.
