摘　　要：中国国际法理论的探索与建构已取得长足进展,但与中国的国际地位、国际法治的实践需求仍有较大距离。中国国际法学界有必要密切关注、细致观察中国国际法实践的导向,推进中国国际法理论的发展。从中国国际法理论的结构性定位上看,要在百年未有之大变局背景下坚守主权独立、维护世界安全、实现民生幸福、崇尚法律制度、促进开放协调、应对风险挑战,应塑造由公正、和谐、人本、秩序、发展、创新构成的价值体系。中国对世界秩序的倡导和承诺为未来中国国际法理论的基本范畴确立了指引方向与参照体系。可以期待,中国国际法理论会在人民中心、互利合作、多边主义、创新发展、绿色低碳等维度上展开,体现历史厚度与世界视野,展示中国与世界法治及政治的互动。未来的国际法中国理论是既能有效解读和阐释中国,又能充分评价和指引世界法治秩序发展的概念、论断和逻辑体系。The exploration and construction of China’s international law theory have made great progress,but there is still a gap between it and China’s international status and the practical needs of international rule of law.It is necessary for Chinese scholars of international law to pay close attention to and observe the orientation of China’s international law practice and promote the development of China’s international law theory.From the perspective of the structural positioning of China’s international law theory,it is necessary to stay committed to sovereignty and independence,safeguard world security,realize people’s happiness,uphold the legal system,promote openness and coordination,and cope with risks and challenges under the background of profound changes unseen in a century.It is necessary to build a value system composed of justice,harmony,humanism,order,development and innovation.China’s advocacy and commitment to the world order have established the guiding direction and reference system for the basic category of China’s international law theory in the future.It is expected that China’s international law theory will be developed in the dimensions of putting the people at the center,mutually beneficial cooperation,multilateralism,innovative development,green and low-carbon,reflecting the historical depth and global vision,and demonstrating the interaction between China and the world rule of law and politics.China’s international law theory in the future is a concept,judgment and logical system that can not only effectively interpret China,but also fully evaluate and guide the development of the world legal order.
