农业知识产权保护与农业科技创新发展探析——以黑龙江省农业科学院为例

摘　　要：农业知识产权包括专利权、植物新品种权、农产品地理标志权和商标权、商业秘密权等,专利是我国农业知识产权中最能体现出新颖性、创造性和实用性的农业科技成果,对于保障我国农业科技的创新发展、增强农业产品的科技竞争力,促进农业经济发展具有重要意义。“十三五”以来黑龙江省农业科学院以政策和资金多举措激发和鼓励全院科研人员创新创造活力,全方面加强农业知识产权保护,大举措推动构建农业新发展格局,实现专利申请数量与授权数量双指标持续增长,涌现出一批具有农业产业特色专利成果,支撑农业知识产权事业向上发展。该文对2011—2020年黑龙江省农业科学院各类型专利申请及授权情况进行整理、统计及分析,系统全面地总结黑龙江省农业科学院涉农专利的现状、发展情况、存在问题,并依据数据分析,提出相关发展建议。Agricultural intellectual property rights include patent rights,new plant varieties rights,geographical indications rights of agricultural products,trademark rights,trade secret rights and so on.Patents are agricultural scientific and technological achievements that can best reflect novelty,creativity and practicality in China’s agricultural intellectual property rights.They are of great significance in ensuring the innovative development of agricultural science and technology,enhancing the scientific and technological competitiveness of agricultural products,and promoting the development of agricultural economy.Since the 13th FiveYear Plan,the Heilongjiang Academy of Agricultural Sciences has adopted various measures of policy and funds to stimulate and encourage the innovation and vitality of the scientific research personnel of the whole academy,strengthen the protection of agricultural intellectual property rights in all aspects,and take major measures to promote the construction of a new development pattern of agriculture,so as to achieve the continuous growth of both the number of patent applications and the number of patents granted.Thus,a number of patent achievements with agricultural industrial characteristics have emerged to support the upward development of the agricultural intellectual property cause.This paper collates,examines and analyzes the application and authorization of various types of patents in Heilongjiang Academy of Agricultural Sciences from 2011 to 2020,and systematically summarizes the current situation,development and existing problems of agriculture-related patents in Heilongjiang Academy of Agricultural Sciences,and according to the data analysis,this paperputs forward relevant suggestions on development.
