摘　　要：农垦国有农用地所有权主体虚置,农垦国有农用地权责边界不清晰、权能体系不完善,农垦国有农用地所有权管理体制机制不健全,是导致宁夏农垦国有农用地所有权管理现实困境的主要原因。创新宁夏农垦国有农用地所有权管理履职模式,应立足于产权理论和“委托-代理”理论,通过丰富产权权能体系,明确农垦国有农用地所有权代理履行主体及职责,合理界定农垦国有农用地使用权权能边界,进一步完善农垦国有农用地承包租赁权权责;区分“公管公营”“职工承包租赁”“非职工租赁经营”“承包租赁权流转”情形丰富所有权实现形式;通过引进市场竞争机制,明确农用地出让方式和出让收益分配机制,加强国有农用地“公管公营”和“两田制”经营管理等路径,构建宁夏农垦国有用地所有权管理制度。The main reasons why the administration of state agricultural land ownership in Ningxia is really in trouble are virtual for the main body of ownership of state-owned agricultural reclamation land,the unclear boundary between the rights and responsibilities of state-owned agricultural reclamation land,the imperfect of power system,the imperfect of ownership management system and mechanism of state-owned agricultural reclamation land.In order to innovate the performance model of property management of stateowned agricultural reclamation land in Ningxia,we should take the property rights theory and the"principal-agency"theory as the basis,through enriching the property rights and functional system,clarifying the main organ and responsibility of the state land agent of agricultural exploitation,reasonably defining the right of use and the functional limit of the state agricultural land of agricultural exploitation and further improving the rights and responsibilities of the contractual leasing right of state-owned agricultural reclamation land;distinguish between"public management and public operation","employee contract rental","non-employee rental operation"and"contract lease transfer"and enrich the forms of ownership realisation;By introducing the market competition mechanism,clarifying the agricultural land transfer and the transfer income distribution mechanism,strengthening the"public-managed and public-operated"state agricultural land and the"two-field system"operating and management paths,and establishing the land property management system of state-owned agricultural reclamation land in Ningxia.
