摘  要:政务数据共享的规范化既可避免行政资源的浪费,又能够从公共利益出发将共享限定在合理范围内。实践中对政务数据共享范围裁量存在引致性、概括性规定过多、操作空间过大等问题,为政务数据资源部门化提供了可能。为了破解上述困境,可以通过利益均衡原则、价值位阶原则、成本收益分析原则的引入,以待提升政务数据共享能力与水平,助力政务数据共享裁量权在高效流转和确保质量之间寻求平衡,实现完全共享类、受限共享与禁止共享界定的规则化、制度化与程序化,裂变式释放政务数据共享权益,保证政务数据共享权在满足行政能动性与保障数据安全的前提下得到充分行使。The standardization of government data sharing can not only avoid the waste of administrative resources,but also limit the data sharing within a reasonable range for the sake of the public interest.In practice,there are some problems in the discretion of the scope of government data sharing including excessive generalization provisions and excessive operation space,providing the possibility for the departmentalization of government data resources.In order to solve the above problem,we should improve the ability and level of government data sharing by introducing the principle of interest balance,of value rank and of cost-benefit analysis.This will help the discretion of government data sharing reach a balance between efficient circulation and quality ensuring,thus realizing the regularization,institutionalization and proceduralization of the definitions of complete sharing,restricted sharing and prohibited sharing.Releasing the right of government data sharing exponentially can ensure that it will be fully exercised on the premise of satisfying administrative initiative and ensuring data security.
